PRIVACY AND TERMS

Terms of Use

1. The ‘OlympicsOn7’ digital content service 

The ‘OlympicsOn7service is a digital content service owned and operated by Seven Network (Operations) Limited, containing content from the PyeongChang 2018 Olympics Winter Games and is accessible via mobile application (“the App”) and website at www.olympicson7.seven.com.au (“the Website”) (“the Service”).  

The Service will be available via the App (accessible on Android and Apple mobile devices) and the Website between 1st February and 26th February (“Games Period”).

The Service contains content which is provided to the public at no charge (“Free Service”) and a premium service is provided to the public for a fee (“Premium Service”) (collectively “Content”), as set out below:

Free Service 
Free Service customers will have 24/7 access during the Games Period to:
  • Live Simulcast of Channel 7, 7TWO, 7Mate, 7Flix, Racing.com 
  • Host Streams - Additional live content from MDS
  • On Demand Highlights - Replays, highlights and magic moments to watch on demand 
  • Event Widgets - Medal tally, Results, Event Schedules and Athlete Profiles
  • Notifications - Alerts on device that a event is about to start 
  • Multi-device - Experience the PyeongChang 2018 Winter Games across six concurrent devices

Premium Service
In addition to all the content accessible in the Free Service, the Premium Service will include:
  • HD Broadcast channels – HD version of 7, 7Two and 7Mate 
  • Host streams in HD (1080p) - delivering a high-quality casting experience
  • Reduced Advertising – Enjoy all the action with less commercial content
  • Access on 8 devices – Access your premium features and content on up to 8 devices and 6 concurrent devices

These Terms govern the supply of the Service. 

Your use of the Service indicates your understanding and acceptance of these Terms, and has the same force and effect as if you had actually signed these Terms. 
In these Terms: 'you' and 'your' mean the customer, and includes members of your household; we, our and us mean Seven Network (Operations) Limited.

2. Accessing the Service – minimum requirements 

To be eligible to access the Service you must be located in Australia and be over the age of 15, or otherwise have your parent’s permission to use the Service. 
You can access the Service by going to the Website at www.olympicson7.seven.com.au, or downloading the App from the Google Play store (for Android) or Apple app store (for iOS).

You must be using a supported device, as listed in our FAQs on the Support page.
You must have a broadband plan with minimum speed of 0.8Mbps (however at least 3Mbps is recommended).
Sign-up is voluntary for the Free Service but mandatory for the Premium Service (as set out in clause 3). 

3. Premium Service

The Premium Service is made available in one of two ways:
a) at a one off flat fee of $14.99 (including GST) to the general public, which you may pay using credit card or debit card (Mastercard or Visa accepted), existing Paypal account (and an invoice will be sent to your email address) or native in app payment within the iOS and Android apps; or
b) redeeming the Premium Service with a premium pass provided by Seven or a Seven Promotional Partner.
In order to use the Premium Service, we require you to sign-up and login using one of the following: 
  • Via your email and password; or
  • Using your Facebook sign on; or
  • Using your Google sign on.

You must provide us with accurate and complete information when you access the Service. You must keep all your identification and user information required to access the Service strictly confidential. You should not reveal your password to anyone nor use anyone else’s password.  You are entirely responsible for all activities that occur through your password and credit card, and you agree to immediately notify us in the event you become aware of any unauthorised use or breach of security.  We will not be responsible for any losses arising out of the unauthorised use of your credit/ debit card.

4. Intellectual Property

You acknowledge that the content that you are able to access, view and display via the Service contains proprietary information and material that is owned by us and our licensors, and is protected by intellectual property and other laws including copyright.  You agree you will not use such proprietary information or materials in any way whatsoever except for use of the Service in accordance with these Terms of Use.  No part of the Service may be reproduced in any form or means except as expressly permitted in these Terms.

Without limiting the foregoing, you may not reproduce or apply any of our trade marks or the Olympic trade marks on any materials. The Olympic Insignia Protection Act 1987 contains additional restrictions in relation to use of Olympic trade marks.

Your use of any Content streamed using the Service is conditional upon your acceptance of these Terms of Use. If you do not agree with them, do not use the Service.

You can download the App onto any number of compatible devices however the Premium Service is viewable on a maximum of six devices concurrently with the same login.

You are authorised to use the Content only for your personal, non-commercial use, and you may not copy, download, redistribute, transfer, sell, rent, lease or otherwise assign or sublicense them to any other person or device, nor in any way alter such Content nor use it in any advertising or promotional materials.

You acknowledge that the Content we provide to you is by way of licence only, and that the Content you access through the Service includes technology that protects digital information and our rights and those of our licensors. 

You agree that you will not attempt to, nor encourage or assist any other person to, circumvent or modify any digital rights management or security technology or software that is part of the Service, nor interfere with, remove or alter any rights management information nor proprietary notices or labels on the Content.

We may monitor your compliance with these Terms from time to time, and in the event of breach by you, we may terminate your use of the Service and take advantage or any available remedies at law.

5. Subtitles and commentary

Subtitles and closed captions are not part of the Service.

In addition, there is not commentary on all live Olympic content streams, and some commentary may be in foreign language and/ or from third party host broadcasters.

6. Availability and accuracy of the Service

We will provide the Service to you in accordance with these Terms, within a reasonable time and using due care and skill. 
We want to give you the best service possible, but sometimes availability of the Service may be affected by factors outside our control. For this reason we cannot guarantee that:
  • the Service will be available to you at all times; 
  • the Service will always be accurate; or 
  • streaming speeds of the Service won't vary from time to time. 

In using the Service, you acknowledge that your use of the Service may not be uninterrupted, timely, secure or error free. You also acknowledge that the Service and the servers that provide you with data and third party content and third party services may not be free of viruses or other harmful components.

On occasion, technical problems or file sizes may delay or prevent Content from being streamed. It may also be necessary for us to interrupt the Service (or parts of it) occasionally in order to upgrade or maintain it. Should we need to interrupt the Service we will, whenever possible, conduct maintenance or upgrades at times that would minimize inconvenience to our customers and restore the Service as soon as possible.

In some circumstances, Premium Service customers may be eligible for a refund and can request one via the online email form found at our Support page.  We will use best endeavours to respond within 24 hours. If your claim is eligible, we will process a full refund to your credit card or PayPal account within 10 business days (subject to any delays caused by your credit card provider or PayPal).  

We do not provide refunds for change of mind or where technical issues occur that are beyond our reasonable control, such as issues with your device, unsuitability of your broadband plan or network congestion.

7. Changes to the Service 

We may at our discretion and from time to time change, add, or remove features and functionality of the Service or discontinue one or some of the features of the Service without notice. If you are dissatisfied with any such changes to the Service, please contact Customer Support (see clause 11).

8. Third Party Links

From time to time the App or Website may display links to third party websites (such as PayPal, Braintree). You understand that you may be required to agree to third party terms and conditions before being provided such access through the Service and that you access and use third party services at your own risk.  

9. Your personal broadband usage

To use the Service you need a minimum speed of 0.8Mbps (however at least 3Mbps is recommended).  You are responsible for checking with your internet service provider as to whether your plan is suitable.  

You are responsible for paying for your personal broadband connection, including any data charges (even if you are able to receive the Premium Service free of charge). 

The content you stream via the Service may be metered by your internet service provider, and counted towards any usage allowance you have and/or be charged to you by your provider. 

If you are an Optus customer on an eligible post-paid mobile plan you can stream Sevens LIVE and Video on Demand event coverage* of OlympicsOn7 “data free” on your mobile or mobile broadband service via the OlympicsOn7 app. Optus Streaming services subject to change at any time and conditions apply. *Content which will not be data free is the following:
  • Advertisements that are displayed when starting a stream in the OlympicsOn7 app, which can be video ads or banner ads
  • Any analytics sent from the streaming services to understand your video preferences and usage
  • Authentication, for example, when the service confirms your login

Streaming quality varies depending on broadband connection speed.  The App uses an adaptive bitrate system that automatically adjusts the quality of the stream based on the device capability and quality of your broadband connection to start the streams as quickly as possible and to minimize buffering to the extent possible in the context of all the various broadband plans our customers have.  However, we are not responsible for buffering which may occur if your broadband plan is not suitable (ie: does not have the minimum speed of 0.8Mbps, or if buffering occurs for other reasons beyond our reasonable control).

10. Advertising

You acknowledge that there may be advertising displayed as part of the Service (including both the Free Service and the Premium Service), providing you information regarding products and services.  

This advertising may be in the form of display advertising, pre-roll advertising (which appears before you start watching Content), mid-roll advertising (which appears during your viewing of the Content) and post-roll advertising (which appears after you have finished watching VOD content).

You acknowledge that the free Service is entirely advertising-funded, and that use of ad blocking software on your device will not block all advertising served by us or on our behalf.  

11.  Customer support

For customer support in relation to your use of the Service go to our Support page where you will find FAQs and an online email form to submit queries.   You are required to provide us with complete and accurate information regarding any customer service query you submit.  

We will use best endeavours to respond to online queries within 24 hours (subject to unexpectedly high traffic).

12. Changes to these Terms and effect of these Terms

We may vary these Terms or any information contained on the Service at any time. However, if a variation is likely to have a detrimental impact on you, and that impact is more than a minor impact, we will notify you of the change no later than when the change becomes effective.

In the event these Terms are inconsistent with any other Terms you have agreed to in relation to your ongoing use of these Terms will prevail to the extent of that inconsistency.   

13. Privacy 

If you are under 15 years old, you must give this Privacy Statement to your parent and get their permission for you to use the Service.

Seven and its Related Bodies Corporate  (“Associated Entities”) is collecting your personal information for the purpose of establishing and administering your access to the Service (along with any future service Seven provides and which requires logging in), including for the purpose of understanding our audiences. If you use your Facebook ID or Google ID to log into the Service, you also consent to us collecting your personal information (such as your public profile including name and email address) from Facebook or Google (as applicable) for these purposes.  Seven will otherwise handle your personal information in accordance with Seven’s Privacy Policy which is available at www.sevenwestmedia.com.au/privacy (and which contains information regarding how you can access your personal information, correct it and/ or make a complaint about our handling of your personal information).  

Seven’s Privacy Policy also contains information regarding the use of cookies and other technologies in order to improve and personalise your experience by identifying and displaying content which may be of interest to you,  referring you to products and services that may be of benefit or interest to you and displaying targeted advertising based on those interests.  

By logging in, and where you elect to provide us with additional information about you and your interests from time to time, you agree to the terms of the Privacy Policy.  Without limiting the foregoing, Seven may disclose your personal information to its related entities, business partners and external service providers for research and profiling purposes as well as other purposes reasonably related to your relationship with Seven.  In addition, by accessing the Service, and where you elect to provide us with additional information about you and your interests from time to time, you consent to Seven using your personal information for the purpose of Seven and its related entities sending you information regarding programs, products and services available through them and/ or through their business partners and to Seven providing your personal information to selected third parties such as Seven’s Promotional Partners who distribute Premium Pass vouchers to their customers, for those third parties to send you information regarding their products and services directly.  We will always provide you with the ability to opt out of those communications.

You also agree that we may use proprietary measurement software and tags on the Service will allow users to contribute to market research, audience ratings services and enable us to deliver more relevant advertising to you.

You consent to us sharing your personal information in connection with your use of the Service with our content licensors in connection with the enforcement of their intellectual property rights.

14.  Supplier Liability 

Except as expressly set forth herein, you expressly acknowledge that this Service is provided ‘as is’ and any use by you of the Service is at your own risk.

To the maximum extent permitted by law, in no event will Seven or its Associated Entities nor its third party licensors be liable for any loss or damage, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with the Service, any linked site, the streaming of any Content or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Seven or its Associated Entities are advised of the possibility of such damages, losses or expenses. 

To the extent permissible by law, we will not be liable under these Terms for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
To the extent permissible by law, our maximum aggregate liability under these Terms whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the product(s) in question. 

If you are a consumer under the Consumer and Competition Act 2010 (Cth) (Australian Consumer Law) the Service comes with consumer guarantees that cannot be excluded under that Law. 

Where there is a major failure with a Service, you are entitled to cancel the Service. You may also seek compensation for any other reasonably foreseeable loss or damage. In the case of the Premium Service, you may also get a refund. 

If the Service fails to be of acceptable quality, and the failure does not amount to a major failure, you are entitled to have the Service resupplied (free of charge and within a reasonable time). If we cannot resupply the Service within a reasonable time, we may instead cancel the Service and, in the case of the Premium Service, offer you a refund, the amount of which will depend on how much of the Service was satisfactorily provided. 

We exclude to the fullest extent permitted by law all terms implied by statute, at law, in fact or otherwise. We also exclude to the fullest extent permitted by law all liability for any liabilities, losses, damages, costs or expenses (whether arising in contract, tort (including negligence) or under any other cause of action) suffered or incurred by any person in connection with this contract or an act or omission of our or any of our suppliers' personnel in connection with this contract:
a) on behalf of and for the benefit of our suppliers; and
b) for ourselves, to the extent permitted by the Australian Consumer Law.
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence.

15. Assignment 

We may transfer all or part of our rights and obligations under these Terms to our business partners or related bodies corporate. However, if assignment is likely to have a detrimental impact on you, and that impact is more than a minor impact, we will notify you about this.
The Service is provided for your personal, non-commercial use, and may not be resold, in whole or in part. 

16. Indemnity

You agree to indemnify and hold us harmless from and against any and all claims, proceedings, injuries, liabilities, losses, costs and expenses (including reasonable attorneys’ charges on an indemnity basis), including but not limited to claims against us or our related companies alleging negligence, copyright infringement and/or trademark infringement, relating to or arising out of your breach of our agreement with you (as contained in these Terms) or your misuse of the Service. 

17. Term, suspension and termination of the Service 

Our agreement with you (as contained in these Terms) commences on the date you first access the Service, and continues until the expiry of the Games Period, unless terminated earlier in accordance with these Terms. 

We retain the absolute right to immediately suspend or terminate your Service, and terminate this agreement with you (as contained in these Terms), if:
a. you breach these Terms in a material way;
b. you misuse (or we can establish you have attempted to misuse) the Service or your use of the Service is reasonably considered by us to be fraudulent or to adversely affect the integrity of the Service or other customers' use of or access to the Service;
c. your credit/ debit card authorisation is withdrawn, or you cancel your credit/ debit card or your card details are changed without notifying us of your new card details;
d. you use the Service in such a manner as to infringe upon our intellectual property rights or those of our suppliers or any third party;
e. we cease to provide the Service, or any part of it, for example in order to comply with our legal obligations (including legislative changes) or Court orders; or 
f. we have reasonable grounds to believe that a threat or risk of security, injury or damage exists.

We may monitor your use of the Service to ensure that you are complying with these Terms. We will comply with our Privacy Policy if we do. 
We may investigate any alleged misuse of the Service and may involve or assist police or other law enforcement agencies in doing so without notice to you. 
Termination will not affect either party's respective rights or remedies.  

18. Applicable Law  

These Terms are governed by the laws in force in New South Wales, Australia, and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia, and any courts which may hear appeals form those courts.

By entering the “Pyeongchang 2018: Win a Toyota Competition (“the Competition”), you are agreeing to the following terms and conditions:

  1. STANDARD TERMS

1.1 - Information on how to enter forms part of the terms of entry.

  1. WHO CAN ENTER?

2.1 - Subject to clause 2.2, entry is open to all residents of Australia aged 18 years or over.

2.2 - Employees (and their immediate families) of Seven Network (Operations) Limited, Ansible Pty Ltd, Gigya Inc., OzTAM, Toyota Motor Corporation  Australia Ltd and their associated agencies and companies are not eligible to enter.

  1. HOW TO ENTER

3.1 - The Competition commences on Monday 29 January 2018 at 09:00 AEDT and concludes on Monday 26 February 2018 at 23:59 AEDT (“Competition Period”).

3.2 - To enter, viewers must log on to www.olympicson7.com.au OR download the Olympics on 7 app, and complete the required sign in or registration process for entry into the Competition during the Competition Period.

3.3 - Each user will be issued one sign in or registration entry only. Users will not be awarded additional entries by signing out and signing in.

3.4 - Additional entries will be issued for every 7 minutes of content viewed via the app or website.

3.5 - The total number of additional entries will be calculated based on total viewing time across the Competition Period. All data required to measure and validate user eligibility for additional entries will be managed by the data and analytics team via Gigya Inc. and OzTAM.

3.6 - The Entrant is responsible for ensuring they have a stable internet connection. Seven Network and its associated agencies and companies are not liable for any internet connectivity issues, howsoever they are caused, that may impact on entrant registration or the calculation of an entrant’s viewing time.

  1. PRIZES

4.1 - There will be one (1) major prize winner (“Winner”) who will receive the relevant prize package detailed in clause 4.2.

Total maximum Prize package is valued from $45,830.00. Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.

4.3 - In accepting the Prize package, the Winner must agree to the following conditions:

  1. The Winner will be required to provide their details to the Prize Sponsor within 8 weeks of being contacted by the Promoter.
  2. Receipt of the Prize package is subject to the Winner being able to lawfully take possession of the Prize and comply with all registration and compulsory third-party insurance requirements of the state/territory in which the Winner elects to register the Prize.
  3. If the Winner of the Prize does not have a valid Australian Driver’s Licence, the Prize can be transferred to a nominated family member upon the approval of the Promoter.
  4. Vehicles depicted in all promotional material relating to the Competition are not necessarily the same colour as the Prize. The colour of the Prize vehicle can be chosen by the Winner from the list of available colours as advised by the Promoter at the time of selection and is at the discretion of the Prize Sponsor and is subject to availability.
  5. The Prize will be delivered to the Winner’s closest Toyota Dealership or as otherwise reasonably nominated by the Prize Sponsor as soon as is practicably possible, however no later than 6 months from the date of the drawing of the Prize. Neither the Promoter nor the Prize Sponsor are liable for any costs associated with the Winner travelling to their nearest Toyota Dealership to collect the Prize.
  6. The Prize includes metallic paint and the following: 12 months’ vehicle registration, 12 months compulsory third party insurance (CTP), stamp duty, and a maximum dealer delivery charge. All other charges including all optional extras and accessories, comprehensive insurance or any other insurance not stated, petrol, personal costs and all other ancillary or related costs not expressly stated do not form part of the Prize and are the sole responsibility of the Winner.

4.4 - The Winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

4.5 - It is a condition of accepting the Prize that the Winner must comply with all the conditions of use of the Prize and Prize Sponsor’s requirements.

4.6 - Prizes cannot be redeemed for cash and are not transferable or exchangeable, unless as stated in clause 4.3.

4.7 - Once the Prize is accepted, the Winner must deal directly with the Prize Sponsor should there be any complications.

4.8 - If the Prize (or an element of the Prize) is unavailable, for whatever reason, the Promoter reserves the right to substitute the Prize (or an element of the Prize) for a prize of equal or greater value, subject to State Regulation.

4.9 - Independent financial advice should be sought as tax implications may arise as a result of accepting the Prize.

4.10 - In accepting the Prize, the Winner agrees to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the Winner grants the Promoter and the Prize Sponsor a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the Winner will not be entitled to any fee for such use.

  1. HOW TO WIN

5.1 - There will be one (1) major prize winner drawn from the national pool of online entrants. Each entrant who has entered the Competition in accordance with these terms and conditions during the Competition Period and registered all details required by Monday 26 February 2018 at 23:59 AEDT will be entered into the draw (“Qualifying Entrant”).  The draw will be held at Ansible Pty Ltd, Level 1, 16 Anster Street, Adelaide SA 5000 on Thursday 1 March 2018 at 09:00 AEDT.

5.2 - A member of the Seven Network Marketing department will contact the winner by a phone call within two days of the draw and a letter advising the winner of their prize will also be express posted. The winner’s entry details will be published in the Public Notes section of The Australian newspaper on Monday 12 March 2018.

5.3 - The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.

5.4 - The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional draw will be conducted.

5.5 - It is a condition of accepting the prize that the winner (and any companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

5.6 - Subject to state government legislation if the winner has not claimed their prize by Friday 1 June 2018 an unclaimed prize draw will take place at Ansible Pty Ltd, Level 1, 16 Anster Street, Adelaide, South Australia 5000 on Monday 4 June 2018 at 10:00 AEST and the winner will be notified by a phone call on the day of the draw and a letter advising the winner of their prize will also be mailed. The winner’s entry details will be published in the Public Notes section of The Australian newspaper on Monday 11 June 2018.

  1. NO LIABILITY

6.1 - In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation.

6.2 - Seven Network (Operations) Limited, Ansible Pty Ltd, Toyota Motor Corporation Australia Ltd and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.3 - Seven Network (Operations) Limited, Ansible Pty Ltd, Toyota Motor Corporation Australia Ltd and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

  1. during the entry process or the draw;
  2. in the participation, acceptance or use of any element(s) of the prize;
  3. as a consequence of late, lost or misdirected mail;
  4. due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; or
  5. arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion.

6.4 - Seven Network (Operations) Limited associated agencies and companies assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available, subject to state government legislation.

6.5 - If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation.

6.6 - By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. Neither the Promoter nor the Prize Sponsor are  responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling.
